Service Terms & Conditions – Emara Health V1.1

These Terms and Conditions of Business (“Terms and Conditions”) apply to the fulfilment of services by ANU CAPITAL LIMITED, trading as Emara Health (“Emara”, “we, “our, “us”), a company incorporated and registered in England with the registration number: 16818531 and registered office address: (Anu Capital) 60 Bridge Street, Kington, United Kingdom, HR5 3DJ. ANU CAPITAL LIMITED trades as Emara Health. For any questions regarding these Terms, please contact admin@emarahealth.co.uk.

For the sake of clarity, ANU CAPITAL LIMITED, trading as Emara Health, is not a medical or healthcare provider.  We do not provide medical treatments, surgical procedures, medical assessments, clinical diagnosis or medical advice. We solely provide non-clinical services. Therefore, we are not responsible for any clinical or medical activities.

These Terms and Conditions set out the legal agreement between us and the individual user (“you”, “the User”), governing the provision of non-clinical services. 

By engaging with Emara Health, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

These Terms and Conditions take precedence over the contents of written material provided Emara Health (in written or electronic format including but not limited to all Emara Health’s websites and social media pages) and/or oral representations made by any employees, sub-contractors, partners or persons otherwise engaged by Emara Health. This is the case except where consumer protection law requires otherwise.

Definitions & Interpretations 

  • “Emara Health” / “Emara” / “we / us / our” – ANU CAPITAL LIMITED (Company No. 16818531), trading as Emara Health.

  • “User” / “you” – An individual who engages Emara Health to provide non-clinical services.

  • “Consultant” – An independent third party who will perform clinical services (which may include surgical procedures e.g. surgical upper blepharoplasty or non-surgical treatments e.g. botox injecting) and consultations and is not employed by or acting on behalf of Emara Health.

  • “Surgeon” – An independent third party who will perform surgical procedures and is not employed by or acting on behalf of Emara Health. At times a Surgeon may provide non-surgical treatments and consultations. 

  • “Treatment Facility” – A third party provider (e.g. hospital, clinic, theatre, or medical facility) operated independently of Emara Health who may provide facilities and space for Surgery, Treatments or consultations.

  • “Booking Fee” – The fee payable to Emara Health for providing a non-clinical booking service.

  • “Clinical Fees” – Any fees payable to third-party providers for medical, surgical, clinical, or facility services, which are not paid to Emara Health.

  • “Treatment” – includes surgical procedures e.g. surgical rhinoplasty and non-surgical, medical treatment e.g. prescribing medications, botox injecting, medical assessments.

  • Surgery – specifically refers to surgical procedures

  • “Non-Clinical Services” – services that are not considered providing a medical service. This includes administrative, or logistical support such as booking appointments, scheduling dates, and passing on information. Non-Clinical Services does not include providing: medical advice, medical opinions, diagnosis, Treatment, Surgery, prescribing, or any other form of clinical decision-making.

Interpretation

Headings are for convenience only and do not affect interpretation. Words in the singular include the plural and vice versa. References to legislation include any amendment or replacement of that legislation.

Scope of Services

Non-Clinical Status

Emara Health solely provides non-clinical services, such as administrative support and logistical support.

No Clinical Liability

For the avoidance of doubt, Emara Health is not responsible for any clinical or medical activities. Any medical or clinical activities if delivered, are provided by independent third party entities (including independent Consultants and Treatment Facilities). You agree that no cause of action in negligence, breach of contract, or statutory duty shall accrue against Emara Health for medical activities (including medical advice and medical treatments) given by an independent third party entity.

Administrative Facilitation

Emara Health agrees to use reasonable endeavours to:

  • Facilitate the scheduling of a consultation between you and an independent Consultant.

  • Facilitate the scheduling of a Treatment day with an independent Consultant.

  • Facilitating the booking of rooms and theatres with an independent Treatment Facility

  • Collect, process and transmit your data to your Consultant and your Treatment Facility for the sake of fulfilling services including scheduling treatment days, scheduling appointments, room bookings and theatre bookings.

Courtesy Post-Treatment Administrative Support

Following your Treatment or Surgery, Emara Health may offer a complimentary, non-clinical courtesy communication via email, text or telephone call. This is a voluntary support service and does not form part of the paid contract. As this is a complimentary courtesy, Emara Health is not liable for any failure to conduct this. 

This support is strictly limited to non-clinical support. If you have any medical concerns or symptoms, you may contact a suitable medical professional or, in an emergency, call 999.

This is provided at Emara Health’s discretion, subject to availability, and does not form part of the paid booking service.

Emara Health does not guarantee the availability, timing, or completeness for this Courtesy Post-Treatment Administrative Support and shall not be liable for any failure to provide such support.

Courtesy Non-Clinical Support

In addition to facilitating Treatment and Surgery booking and scheduling, Emara Health may provide non-clinical administrative support, which may include booking and scheduling consultations, assistance with directions, appointment reminders, coordination of transport or accommodation (where applicable), and general logistical communications. All such services are strictly non-clinical and do not include medical advice, diagnosis, or treatment. 

This is provided at Emara Health’s discretion, subject to availability, and does not form part of the core paid booking service.

Emara Health does not guarantee the availability, timing, or completeness for this Courtesy Non-Clinical Support and shall not be liable for any failure to provide such support.

Instructing Emara Health

By engaging Emara Health to provide the Administrative Facilitation, you instruct and authorise Emara Health to carry out reasonable administrative and logistical actions incidental to completing and supporting that booking, as well as to provide the aforementioned Courtesy Non-Clinical Support and Courtesy Post-Treatment Administrative Support.

Minimum Age

The minimum age for engaging with any of our services is 18 years of age.

Independent Third Parties

All clinical contracts are directly between you and the third-party provider. This includes agreements and contracts relating to clinical services. 

Any obligations, responsibilities, or agreements between you and any third-party are strictly between you and the third party. Emara Health is not a party to such agreements and does not assume any duty, responsibility, or liability arising from them. Emara Health shall not be liable for any acts, omissions, outcomes, complications, or negligence of any third-party.

Emara Health does not control or influence clinical decisions and shall not be liable for any outcome, complication, or negligence arising from the treatment or any other medical activities. 

We do not endorse or “recommend” specific surgeons or Consultants. All surgeons and Consultants work independently of Emara Health. 

We do not endorse or “recommend” specific healthcare providers, theatre facilities, surgical facilities, or Treatment Facilities. All healthcare providers, theatre facilities, surgical facilities and Treatment Facilities work independently of Emara Health.

User’s Obligations

You must be over the age of 18 and we may ask for proof of ID.

You are responsible for choosing your own Surgeon, Consultant, healthcare provider and Treatment Facilities.

You agree to provide honest, accurate, and complete information at all times to Emara Health, and any third party involved in delivering a medical service to you, this may include a Consultant, surgeon, healthcare provider, healthcare facilities, surgical facilities and Treatment Facilities. And you agree that Emara Health is not responsible for any negative consequences that result in you providing dishonest information.

You acknowledge that any advice provided by Emara Health staff or assistants is strictly non-clinical.

You are responsible for settling your fees.

You acknowledge that you contract directly with third parties for clinical services. While Emara Health facilitates bookings on an administrative basis, it does not verify, guarantee, or warrant the qualifications, registrations, or suitability of any such third parties. You remain responsible for satisfying yourself that the third parties are appropriate for your needs.

You acknowledge and agree that Emara Health and its staff and contractors have no clinical or medical training. They are not qualified, authorised or able to: 

  • Provide any form for medical advice, medical diagnosis and medical treatment.

  • Assess the urgency of any medical condition or medical symptoms;

  • Identify medical “red flags” or life-threatening symptoms

  • Provide clinical triage or medical advice.

You expressly agree not to disclose or communicate any clinical symptoms, medical concerns, or health-related queries to Emara Health staff. You acknowledge that if you do disclose such information, Emara Health staff are not trained to recognise its significance and cannot be held liable for any failure to advise you to seek medical attention.

Inaccurate Medical History Indemnity

You acknowledge that Emara Health relies on the information you provide for the purpose of administrative coordination. You confirm that all medical history, health declarations, and related information you provide to Emara Health, your Consultant, your Treatment Facility are true, accurate, complete, and not misleading.

You agree that Emara Health shall not be responsible for any loss, damage, delay, cancellation, adverse outcome, or additional cost arising from inaccurate, incomplete, or misleading medical or health-related information provided by you.

To the extent permitted by law, you agree to indemnify and hold harmless Emara Health from and against any claims, losses, damages, liabilities, costs, or expenses (including reasonable legal fees) suffered or incurred by Emara Health as a result of: 

  • inaccurate, incomplete, or misleading medical or health information provided by you; 

  • or any failure by you to disclose relevant medical history, medications, allergies, or conditions when requested by your Consultant or your Treatment Facility.

Nothing in this clause limits or excludes any statutory rights you may have as a consumer.

Assignment and Sub-Contracting

Emara Health may assign, transfer, novate, or subcontract any of its rights or obligations under these Terms to a third party, provided that this does not materially reduce the level of service provided to you.

You may not assign, transfer, or subcontract your rights or obligations under these Terms without the prior written consent of Emara Health.

Nothing in this clause creates any partnership, joint venture, or employment relationship between you and Emara Health or between Emara Health and any third party engaged in connection with the facilitation services.

Fees & Payments

Fees Payable

Emara Health provides a booking service. This is a paid service that consists of facilitating and confirming a Treatment booking with an independent third-party provider. It is purely a non-clinical administrative service in accordance with your instruction. Once the Treatment booking is confirmed, Emara Health’s contractual service is deemed to have been fully performed.

You agree to pay a fee for the provision of the booking service (“Booking Fee”, “Facilitation Fee”). The Booking Fee is payable in advance and relates solely to the administrative act of securing a Treatment booking.

The Booking Fee does not include any clinical, surgical, medical, theatre fees, or facility fees, which are payable separately to the relevant third-party provider.

For the avoidance of doubt, this Booking Fee that is payable to Emara Health, does not include and is separate from:

  • surgeon or consultant fees;

  • clinical or medical fees;

  • hospital, clinic, theatre, or facility charges;

  • medication or medical aftercare costs

For the avoidance of doubt, all clinical and medical fees are payable directly to the relevant third-party provider.

When Payment Is Due

Payment of the Booking Fee is required before any booking is facilitated. No booking will be initiated until payment has been successfully received.

Commencement of Performance

By submitting payment, you expressly request Emara Health to begin providing the booking service immediately.

Completion of Service

The booking service is deemed fully performed and complete at the moment Emara Health receives confirmation from the relevant third-party provider that the Treatment has been successfully booked and communicates that confirmation to you by email, text message, or other written means. 

Once this confirmation has been issued, no further contractual service remains outstanding from Emara Health.

Once the service is fully performed, you lose your legal right to cancel this contract and the Booking Fee becomes entirely non-refundable, regardless of whether the 14-day cooling-off period has expired.

Taxes

All fees are stated inclusive of VAT where applicable, unless expressly stated otherwise. You are responsible for any additional taxes, duties, or charges required by law in connection with your use of the services.

Cancellations, Rescheduling & Termination

Termination by You

You may terminate this agreement at any time by providing written notice to us.

Where termination occurs:

  • after the 14-day cooling-off period has expired; or

  • where the Consumer Contracts Regulations 2013 do not apply (for example, where you are acting in the course of business),

you will remain responsible for payment of:

  • all services properly provided up to the effective date of termination; and

  • any costs or commitments reasonably incurred by us in connection with the provision of the services.

Termination by Us

We may terminate this agreement immediately by written notice if:

  • you materially breach these Terms and fail to remedy the breach within a reasonable period after being notified;

  • you fail to make payment when due;

  • you provide inaccurate, misleading, or incomplete information that materially affects our ability to provide the services; or

  • you fail to provide necessary administrative information;

  • you engage in abusive, threatening, or unreasonable behaviour towards Emara Health;

  • continued provision of the services would be unlawful, unethical, or contrary to professional or regulatory obligations;

  • circumstances arise outside Emara Health’s reasonable control which make continued service provision impracticable.

Termination by Us For Convenience

We may terminate this Agreement at any time by written notice to you where we reasonably determine that we do not wish to proceed with providing the booking service. In this situation specifically, any Booking Fee paid will be refunded in full, and neither party shall have any further liability to the other arising from such termination.

Termination under this clause does not affect any rights or obligations that have already accrued prior to termination.

Any reference to “written notice” in this includes notice sent by email to the most recent email address provided by you, unless otherwise stated. Written notice will be deemed received at the time it is sent, provided no delivery failure notification is received.

Rescheduling

Where services are scheduled for a specific date or time, any request to reschedule must be made with reasonable notice.

We reserve the right to treat late cancellations or repeated rescheduling requests as a termination for the purposes of this section, where this results in lost time or irrecoverable costs.

Consequences of Termination

Upon termination for any reason:

  • all outstanding invoices become immediately payable;

  • we will cease providing the services; and

  • any licences, permissions, or access granted to you in connection with the services will end.

  • any refund due (if applicable) shall be calculated in accordance with these Terms, including the Consumer Right to Cancel and Early Performance provisions;

Termination does not affect any rights, remedies, or liabilities that have accrued prior to termination.

Clauses relating to liability, data protection, confidentiality, jurisdiction, and governing law shall survive termination.

Accrued Fees and Refunds

Fees paid are non-refundable except where: required by law; or expressly stated otherwise in these Terms.

Where a refund is due, it will be calculated on a proportionate basis having regard to the services provided up to the termination date and issued in accordance with Section Refund.

Refund

Where a refund is approved in accordance with these Terms, refunds will be made to the original payment method used at the time of booking. Refunds will be processed within a reasonable time and may take several business days to appear, depending on the payment provider. Emara Health cannot issue refunds in cash.

Complaints & Dispute Resolution

Scope of Complaints

Emara Health handles complaints relating solely to its non-clinical booking and administrative services.

Complaints concerning clinical care, medical advice, treatment outcomes, or the conduct of Surgeons, Clinics, or Facilities must be directed to the relevant third-party provider.

How to Make a Complaint

Any complaint regarding Emara Health’s services should be submitted in writing by email to admin@emarahealth.co.uk and should include sufficient detail to allow us to investigate the matter.

Acknowledgement & Response

Emara Health will acknowledge receipt of a complaint within 3 business days of receipt and aims to provide a substantive written response within 20 business days. Where a complaint is complex and requires additional time, we will keep you informed of progress and provide an updated timeframe.

Resolution

We will make reasonable efforts to resolve complaints fairly, promptly, and in good faith. Where appropriate, we may propose a mutually agreed resolution.

Mediation & Escalation

If a complaint cannot be resolved through our internal process, the parties may, by mutual agreement, seek to resolve the dispute through mediation or other alternative dispute resolution (ADR) methods.

Participation in mediation or ADR is voluntary and does not restrict or prevent either party from pursuing their legal rights.

Legal Rights

Nothing in this section limits or excludes your statutory rights or your right to pursue legal remedies through the courts of England and Wales.

Limitation of Liability

Scope of Liability

Emara Health provides non-clinical services only.

To the extent permitted by law, Emara Health shall not be liable for:

  • any clinical, medical, or surgical services, advice, or treatment provided by any third-party including third party Surgeons and Facilities;

  • any acts, omissions, negligence, or misconduct of third-party providers;

  • any clinical outcomes, complications, adverse events, or results arising from medical treatment;

  • cancellations, postponements, rescheduling, or changes to treatment dates made by third-party providers or you;

  • any indirect, consequential, special, or incidental losses, including loss of profit, loss of opportunity, or distress.

Liability Cap

To the extent permitted by law, Emara Health’s total aggregate liability arising under or in connection with this Agreement, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to the amount of the Booking Fee paid by you for the booking service giving rise to the claim. When an alternative payment has been paid then limited to the amount of the alternative payment. In any other situation, then limited to £350. 

Mandatory Legal Carve-Outs

Nothing in these Terms and Conditions excludes or limits Emara Health’s liability for:

  • death or personal injury caused by Emara Health’s negligence;

  • fraud or fraudulent misrepresentation;

  • any other liability which cannot lawfully be excluded or limited under applicable law.

Consumer Rights

Nothing in this section affects your statutory rights as a consumer under the laws of England and Wales.

Indemnities

User Indemnity

You agree to indemnify and hold harmless Emara Health from and against any losses, damages, liabilities, costs, or expenses (including reasonable legal fees) suffered or incurred by Emara Health as a direct result of:

  1. any inaccurate, incomplete, or misleading information provided by you, including but not limited to medical history, personal details, or availability information;

  2. your breach of these Terms and Conditions; or

  3. your misuse of Emara Health’s services or materials in a manner contrary to these Terms.

Scope and Limitations

This indemnity applies only to the extent that the loss or liability arises from your actions or omissions and does not apply to losses caused by Emara Health’s own negligence, breach of contract, or failure to comply with applicable law. Nothing in this clause limits or excludes any statutory rights you may have as a consumer.

Intellectual Property

Ownership

All intellectual property rights, including but not limited to copyright, database rights, trademarks, logos, branding, written content, communications, documentation, and materials created, provided, or made available by Emara Health in connection with the services (the “Materials”) are owned by or licensed to ANU CAPITAL LIMITED trading as Emara Health.

Nothing in these Terms transfers ownership of any intellectual property rights to you.

Limited Licence to Use

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Materials solely for your personal use and only for the purpose of receiving and benefiting from the services.

This licence does not permit any commercial use of the Materials.

Restrictions on Use

You must not, without Emara Health’s prior written consent:

  • copy, reproduce, modify, adapt, or create derivative works from the Materials;

  • distribute, publish, sublicense, sell, or otherwise exploit the Materials for commercial purposes;

  • use the Materials in a misleading, unlawful, or defamatory manner; or

  • remove or alter any copyright, trademark, or proprietary notices.

Third-Party Content

Where Materials include content owned by third parties, such content remains the property of the relevant third party and is provided for informational or administrative purposes only.

Emara Health transmits information supplied by third-party providers in good faith and does not warrant or guarantee its accuracy, completeness, or currency. Responsibility for the accuracy and completeness of such information rests solely with the relevant third-party provider.

Emara Health shall not be liable for any loss arising from reliance on information supplied by a third party, except where required by law. Emara Health will use reasonable endeavours to pass on updated or corrected information where it becomes aware of material changes.

Consumer Right to Cancel (B2C)

If you are a consumer (acting for purposes wholly or mainly outside your trade, business, craft or profession), you have a legal right to cancel this contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Cooling-Off Period

You have the right to cancel this contract within 14 days of the date the contract is formed, without giving any reason.

This right to cancel applies only until the booking service has been fully performed. Once Emara Health has confirmed the Treatment booking with the relevant third-party provider, the service is complete and the right to cancel no longer applies, subject to statutory requirements.

How to Cancel

To exercise your right to cancel, you must inform us of your decision to cancel by a clear statement by emailing admin@emarahealth.co.uk. 

You may use the cancellation wording set out below, but this is not mandatory:

“I hereby give notice that I cancel my contract for the supply of services.”

The cancellation notice must be sent before the 14-day cancellation period expires.

Effect of Cancellation

If you cancel within the 14-day cooling-off period and services have not yet begun, we will refund all payments received from you without undue delay and no later than 14 days after we are informed of your decision to cancel. Refunds will be issued using the same payment method used for the original transaction. Please note that processing times may vary depending on your payment provider.

When the Right to Cancel Is Lost

Your right to cancel will be lost once the services have been fully performed, provided that: 

  • performance began only after you made an express request, and

  • you acknowledged that you would lose your right to cancel once the contract had been fully performed.

Where services have started but not been completed, your refund (if any) will be subject to proportionate charges.

Early Performance Consent

Request to Begin Services

If you request that we begin providing services during the 14-day cooling-off period, you expressly agree that performance may start before that period ends.

Effect on Cancellation Rights

By requesting early performance:

  • You acknowledge that if you cancel the contract after services have begun, you will be required to pay for the services provided up to the point of cancellation, calculated on a proportionate basis.

  • You acknowledge that if the services are fully performed during the cooling-off period, you will lose your right to cancel.

No Emergency or Medical Reliance

Emara Health does not provide emergency services, medical advice, clinical assessment, diagnosis, or treatment and must not be relied upon in the event of a medical emergency or urgent medical concern.

In the case of an emergency, you may seek immediate medical assistance by calling 999.

You acknowledge and agree that Emara Health is not responsible for:

  • responding to medical emergencies;

  • assessing the urgency or seriousness of medical symptoms; or

  • any loss, harm, or delay arising from attempting to rely on Emara Health instead of appropriate medical or emergency services.

  • providing a medical service, medical advice, medical assessment, medical diagnosis or medical treatment.

This provision applies at all times, including during any administrative communications, courtesy follow-ups, or transmission of information facilitated by Emara Health.

Data Protection & Confidentiality

Emara Health processes personal data in accordance with applicable data protection laws, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Emara Health is not a medical or healthcare provider. We process personal data, including health-related information where necessary, solely for the purpose of providing non-clinical booking and administrative services.

Data Processing

We process your personal data to:

  • perform our contractual booking services;

  • communicate with you regarding bookings and scheduling;

  • liaise with independent third-party providers; and

  • comply with our legal and regulatory obligations.

Data Sharing

You acknowledge and agree that Emara Health may share relevant personal data with:

  • independent Surgeons, Consultants medical professionals healthcare providers, hospitals, clinics, and Treatment Facilities for the purpose of arranging and managing bookings;

  • third-party service providers engaged to support our administrative operations;

  • legal advisers, regulators, insurers, banks, or payment providers where required by law or contractual necessity; and

  • relevant public authorities where disclosure is legally required.

We do not sell your personal data and do not share it for marketing purposes without your consent where required by law.

Confidentiality

Both you and Emara Health agree to treat personal data and information shared in connection with the booking service as confidential, except where disclosure is:

  • necessary to provide the booking service;

  • required by law or regulation; or

  • permitted under our Privacy Policy.

Data Protection Officer

Our Data Protection Officer is Awais Ul-Hassan and can be contacted at admin@emarahealth.co.uk.

For the purposes of data protection law, Emara Health acts as an independent data controller in respect of personal data processed for administrative and booking purposes. Independent Consultants, surgeons Treatment Facility and other relevant third-parties may act as separate data controllers in respect of clinical and medical data processed for the provision of healthcare services. Emara Health does not control how third-party providers process clinical data and is not responsible for their data protection practices.

Medical Information Sharing for Administrative Purposes

To provide its non-clinical booking and administrative services, Emara Health may need to request, receive, use, and share personal information, including health-related information where relevant, on an administrative and logistical basis

You acknowledge and agree that Emara Health is authorised to:

  • request and receive relevant information from independent Consultants, surgeons, hospitals, clinics, medical professionals, Treatment Facility, and related third-party providers; and

  • share your information that is relevant with such third parties,

solely for the purposes of booking, scheduling, coordination, logistics, and the provision of related non-clinical support services, which may include assistance with appointments, transport coordination, directions, and administrative communications. This information may include medical notes, health information and images.

Emara Health does not provide medical advice, diagnosis, treatment, or clinical decision-making and does not use such information for clinical purposes.

Processing and sharing of such information is limited to what is reasonably necessary to provide the services and is carried out in accordance with applicable data protection law and Emara Health’s Privacy Policy.

If you choose not to provide, restrict, or object to the sharing of information necessary for administrative coordination, you acknowledge that Emara Health may be unable to provide some or all of its services.

This authorisation is intended to permit third parties including Consultants, surgeons, hospitals, clinics, medical professionals, Treatment Facility to lawfully disclose relevant administrative and health-related information to Emara Health for the purposes described above.

Force Majeure

Emara Health shall not be liable for any failure or delay in the performance of its obligations under these Terms where such failure or delay results from events beyond its reasonable control (“Force Majeure Event”), including but not limited to acts of God, pandemic or epidemic, government action or regulatory restrictions, strikes or labour disputes, transport failure, utility or telecommunications outages, fire, flood, or closure third-party facilities.

Where a Force Majeure Event occurs, Emara Health will use reasonable endeavours to notify you and to resume performance as soon as reasonably practicable. If the Force Majeure Event continues for a prolonged period such that performance becomes impracticable, Emara Health may terminate the Agreement in accordance with these Terms without liability, save for any fees properly incurred for services already provided.

Illegality 

If any provision or term of these Terms and Conditions or any part of them shall become or be declared illegal, invalid or unenforceable for any reason whatsoever such terms or provisions shall be divisible from these Terms and Conditions and shall be deemed to be deleted. The deletion of any such clause will not render these Terms and Conditions void, voidable or unenforceable.

Acknowledgement & Acceptance

By engaging Emara Health’s services, you acknowledge and confirm that:

a) you have read, understood, and agree to be bound by these Terms and Conditions;

b) you understand that Emara Health provides non-clinical administrative booking services only and does not provide medical advice, medical diagnosis, or medical treatment;

c) you understand that all clinical care, medical advice, procedures, and outcomes are provided solely by an independent third-party;

d) you understand when Emara Health’s booking service is performed and completed, and the effect this has on refunds and cancellation rights; and

e) you consent to Emara Health processing and sharing your personal data for the purpose of providing the booking service, in accordance with our Privacy Policy and these Terms and Conditions.

f) you have read, understood and agree to the Website Use Terms and Conditions.

Entire Agreement

These Terms and Conditions embody and set out the entire agreement and understanding between and amongst you and Emara Health, and supersedes all prior oral or written agreements, understandings or arrangements. 

You acknowledge that you have not relied on any statement, representation, assurance, or warranty not expressly set out in these Terms and Conditions when entering into this agreement.

Nothing in this clause limits or excludes liability for fraud or fraudulent misrepresentation.

Waiver

No failure or delay by Emara Health to exercise any right or remedy under these Terms and Conditions shall operate as a waiver of that or any other right or remedy. Any waiver by Emara Health of a breach of these Terms and Conditions shall be effective only if made in writing and shall not be deemed a waiver of any subsequent breach.

No Variation

There can be no variation or exceptions to these Terms and Conditions unless agreed in writing and countersigned by a Director of Emara Health. Emara Health reserves the right to amend, change or delete such terms and conditions as it deems appropriate. 

Zero Tolerance

We reserve the right to ensure our staff are treated with respect at all times. Any deviation from this may result in refusal of services.

Jurisdiction

 

The laws of England and Wales shall apply to this contract and the Courts of England and Wales shall have exclusive jurisdiction.
